Terms of service.

What we are

Instinctor is the web production platform: a 3D visual builder, ecommerce, AI live chat, SEO workspace, and one-click deploy. We sell access to the platform and license keys for self-installs. We are the rails underneath.

Your account

You must be 18 or older to create an account. One account per person; do not share credentials. You are responsible for activity under your account, for keeping your password safe, and for telling us at helpdesk@instinctor.com if you suspect unauthorized access. We may verify your identity for billing or compliance reasons.

What you pay

The Instinctor subscription is $29.90 a month or $249 a year, billed by Stripe. Lifetime licenses for self-install are sold separately.

Refunds

The $29.90 monthly platform fee is non-refundable once the period starts; cancel before the next renewal to avoid the next charge. Lifetime licenses are refundable within 30 days of purchase, no questions asked. If we terminate your account without cause, we refund unused subscription time pro rata.

Cancellation

Subscriptions cancel at the end of the current period. If your card fails, the site stops working and we do not pursue you for any balance. Lifetime licenses are non-refundable after 30 days.

Termination

You can close your account at any time from billing settings. We may suspend or close accounts that violate these terms, we will email first whenever possible. On termination you have 30 days to export your data; after that we may delete it. Termination does not refund pre-paid commitments unless we terminated without cause.

Ecommerce merchants

If you sell products or services through your Instinctor site you are the merchant of record. You are responsible for the accuracy of your listings, fulfillment, returns, customer support, sales tax, and regulatory compliance. You must comply with Stripe’s prohibited and restricted businesses list. We do not store credit card data; Stripe handles all card processing.

Content ownership

Your content, brand, copy, and credentials are yours from day one. We never use your content or brand outside the services we provide to you. You can export your site or move it to other hosting at any time.

License to your content

You grant Instinctor a non-exclusive, royalty-free, worldwide license to host, store, copy, transmit, render, and back up the content you upload (text, images, video, code, products) for the sole purpose of providing the service to you. The license ends when you delete the content or close your account. We do not use your content for marketing, training data, or any purpose outside running the service.

Attribution

Every page published with Instinctor includes a small Powered by Instinctor link in the footer. It is part of the service and stays on all published pages, on every plan.

No-hostage rule

If you cancel, you take your data with you, pages, products, images, copy, orders, exported within 30 days. The live install runs on the platform; when your subscription ends, the install stops.

SMS and messaging

If you provide a phone number to us or to a site running on Instinctor, we use it only to deliver messages you opted in to receive. We do not sell, rent, share, or trade your phone number, contact information, or message content with third parties or affiliates for marketing or any other purpose. Consent is not transferred between brands or sites, opting in to one does not opt you in to another. Message frequency varies by service. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help. Carriers (Verizon, AT&T, T-Mobile, etc.) are not liable for delayed or undelivered messages.

AI features

Instagent and other AI tools generate responses using third-party language models. Output may be inaccurate, out of date, or unsuitable for your situation; do not rely on AI output for legal, medical, financial, or other professional advice. Do not enter passwords, payment details, or sensitive personal data into AI chat. We do not use your private chat conversations to train external AI models. We may use anonymized, aggregated metrics to improve the service.

Privacy

Our Privacy Policy at instinctor.com/privacy describes what we collect, why, how long we keep it, who we share it with, and how to exercise your rights. If you are in the EU/UK or California you have specific rights to access, correct, delete, or export your personal data, email helpdesk@instinctor.com. The Privacy Policy is part of these terms by reference; if there is a conflict, the Privacy Policy controls on privacy matters.

Copyright and DMCA

We respect copyright. If you believe content on Instinctor infringes your copyright, send a notice to our designated agent at helpdesk@instinctor.com (subject “DMCA notice”) including (a) your contact info, (b) a description and location of the work, (c) a statement under penalty of perjury that you are the rights holder or authorized to act for them, and (d) your physical or electronic signature. Repeat infringers will have their accounts terminated. Counter-notices follow the procedure in 17 U.S.C. § 512(g).

Acceptable use

No illegal content, no spam, no malware, no scraping at scale. We may suspend sites that violate these rules; we will email you first whenever possible.

Beta features

Features marked beta, experimental, or preview are still under development. They may change, break, or be removed without notice. They are provided as-is with no SLA, no uptime commitment, and no warranty.

Third-party services

Instinctor integrates with services we do not own. Stripe (payments), hosting partners (deploy targets), Twilio or equivalent (SMS), OpenAI or equivalent (AI), screenshot capture services, and others. We are not responsible for outages, data breaches, terms changes, or pricing changes at these third parties. Where a third party’s terms apply (e.g., Stripe, hosting partners), you must accept them separately.

Indemnification

You will indemnify Instinctor against claims, damages, and costs (including reasonable legal fees) arising from your content, your products, your customers, your conduct, or your violation of these terms. We will tell you promptly about any claim and let you choose counsel for any defense you fund.

No warranties

We do our best work every time but cannot guarantee any specific business outcome. Uptime target is 99.9%. If we miss it badly we will credit you pro rata.

Liability

Our maximum liability for any claim is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential damages.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to conflict-of-laws rules. Any dispute that cannot be resolved by good-faith email exchange must be brought in the state or federal courts located in Philadelphia County, Pennsylvania. You and Instinctor each waive the right to a jury trial. Class actions are waived.

Changes to these terms

We will email you at least 30 days before any material change. If you do not like the new terms you can cancel before they take effect.
